Terms of Distance Purchase – CONTRACT


The Distance Purchase Terms define:

    The order of buying and selling

    The rights and obligations of the Seller and the Buyer

    Terms of purchase and payment for Goods and/or services

    Procedures for delivery and return of Goods

    The liability of the Seller and the Buyer

    Other matters related to the purchase and sale of Goods

The Seller

The Buyer
A natural or legal person who places an order on opentools.lv, makes payment in the ways specified, and agrees to the Terms of Use. The distance contract applies to all orders made online and does not apply to in-person purchases.

Goods
Products available on opentools.lv. All prices are in EUR and include 21% VAT. Prices do not include delivery costs. In-store pickup at the OPEN TOOLS point is free of charge.

Subject of the Contract and Purchase Rules
The sale is carried out via an online offer, concluding a Distance Contract between the Buyer and the Seller. By clicking "Confirm Purchase", the Buyer agrees to receive the delivery document (invoice) electronically without a physical signature.
Orders are processed every working day (9:00 - 18:00). For urgent purchases, please contact us by phone. OPEN TOOLS reserves the right to process large orders only after payment is received. Stock levels are informative; if an item is unavailable, we will offer a replacement or notify you of the next delivery.

Delivery Times and Procedures
Goods are delivered via Omniva, Venipak, and LP Express (Unisend) to parcel machines or via courier to the specified address. For in-stock items, parcel machine delivery usually takes 2-3 working days, and courier delivery 3-5 working days. Goods are delivered to the front door of the building/site without a carry-up service.

Returns and Right of Withdrawal
For private individuals (Consumers): The consumer has the right to withdraw from the purchase within 14 calendar days. Notifications must be sent to [email protected]. The product must be unused, undamaged, and in its original packaging. Refunds are processed within 14 days after inspection. Return shipping costs are borne by the Buyer.
For legal entities (B2B): The statutory 14-day withdrawal right does not apply. B2B returns are handled individually or according to the partnership agreement.

Warranty
All goods have a manufacturer's warranty. For individuals, the statutory period is 24 months. For legal entities, the manufacturer's commercial warranty applies (usually 1-2 years). Proof of purchase is required. The warranty is void if damage is caused by the Buyer (mechanical damage, improper use, unauthorized repair, external factors, broken seals).

Dispute Resolution and Applicable Law
Complaints must be sent to [email protected] and are reviewed within 7 working days. Consumer disputes are resolved according to Consumer Rights Protection Laws (with the right to contact PTAC). Disputes with legal entities (B2B) are resolved through negotiations or, failing that, in the courts of the Republic of Latvia.

Final Provisions
By concluding the Transaction, the Buyer confirms agreement with these Terms. The Seller reserves the right to amend the Terms unilaterally.
